If you do not agree to these terms, you should not use our services. We reserve the right to amend these terms at any time.
SoldMine B.V., located at 3011 HV Rotterdam, the Netherlands, Scheepmakerspassage 183 (“SoldMine,” “we,” “us”), provides private individuals (“customers”) with the opportunity to sell electronic devices under the following Terms and Conditions as part of a trade-in programme. SoldMine provides the digital infrastructure for this process, while the execution of the trade-in programme is handled by a third party. SoldMine collaborates contractually with Valyuu B.V. for this purpose.
General Scope
By using our service and agreeing to our Terms and Conditions, you confirm that you are a private individual residing in the EU and legally capable of entering into a binding contract. A customer, as defined by the Terms and Conditions, must be a natural person who has reached the age of eighteen.
Customers are required to provide their full contact information, including their full name, address, current phone number, and email address. Customers are solely responsible for the accuracy of the information they provide and are liable for any costs incurred due to incorrect contact details.
Collaboration with Third Parties
The processing, evaluation, and trade-in of electronic devices are handled by Valyuu B.V., which is responsible for:
• Managing the shipping of devices from end-users to inspection centres
• Conducting thorough inspections of devices to assess their condition
• Accepting or rejecting devices for trade-in
By using our service, you automatically accept the Terms and Conditions of the third-party providers involved. The Terms and Conditions of Valyuu B.V. can be found here.
Contract Formation
When you offer us an electronic device for sale through the trade-in programme on the website you are currently visiting, and the device meets the requirements outlined in Valyuu B.V.’s Terms and Conditions, you are making a binding offer (“offer”). The contract for the purchase, based on our Terms and Conditions, is exclusively between the customer and Valyuu B.V.
You are required to provide complete and truthful information necessary for the offer. By submitting the binding offer, you confirm that you are the sole rightful owner of the device and that the device is free from any third-party rights.
We expressly advise you to read the Terms and Conditions of Valyuu B.V. before submitting a binding offer.
Please note: Once you submit a binding offer, it is no longer possible to have your device returned. You may only retrieve your device if we make you a new offer, which you decline. In such cases, your device will be returned to you.
Payment
If the contract between the customer and Valyuu B.V. is formed upon our confirmation to the customer or upon acceptance of a new offer by the customer, we will pay the agreed purchase price.
Before completing the binding offer, the customer selects one of the available payment methods in the questionnaire. SoldMine cannot guarantee any later adjustments to the payment method.
If the customer chooses a cash payment, the amount will be transferred to the customer’s specified bank account within two working days. If the customer selects an alternative payment method, such as website-specific gift vouchers or discounts, timely delivery is at the discretion of the website owner.
Liability
Any direct or indirect liability by SoldMine is excluded. However, this does not apply in cases where cardinal obligations are breached. Cardinal obligations are those essential to the proper execution of the contract, and their fulfilment can be regularly relied upon by the contractual partner.
The customer is liable for all damages and additional expenses resulting from incorrect, incomplete, or untruthful information provided in the offer, provided the customer is at fault.
Data Protection
SoldMine collects, stores, and processes customers’ personal data solely for the purpose of contract fulfilment and in compliance with applicable data protection laws.
Customer data is only shared with third parties as necessary for the evaluation, trade-in, or return of the device.
The customer has the right to request access to their stored data at any time and to request the deletion of their data unless legally excluded.
Final Provisions
If any provision of our Terms and Conditions or any provision within other agreements between the customer and SoldMine violates legal regulations or becomes invalid or unenforceable for any reason, the validity of the remaining provisions or agreements shall not be affected.
We reserve the right to amend or update these Terms and Conditions at any time. Any such changes will be communicated to the customer via email or by publishing an updated version on our website.
